1. Guest will be charged a pre-payment of 50% of the total price after reservation and the remaining balance is due 60 days before arrival date.
2. The Guest agrees to abide by all rules and regulations set forth by local laws.
3. The Guest shall behave respectfully and shall be good neighbours respecting the surrounding property owners' rights. Parties, loud music, loud singing or screaming that disturbs our neighbours are forbidden. Quiet hours are from 22:00 until 9:00. Creating a disturbance of the above nature shall be grounds for immediate termination of this Agreement.
4. The Guest commits not to use the property for any illegal or commercial purpose, including but not limited to sub-lease the property or otherwise allowing anyone or more people to stay above the maximum permitted or if not previously agreed with the Owner.
5. The Guest is responsible for any breakage or damage costs (or related costs) in or to the property - along with any extra charges that may result - which are caused by the Guest or any members of the Guest's party.
6. The Owner can refuse to allow the Guest into the property or ask the Guest to leave if they reasonably believe the Guest or any member of the Guest’s party (or any other person invited by the Guest to the property) are behaving illegally or that any damage is likely to be caused, has been caused or is being caused as a result of the Guest behaviour or any members the Guest has invited to the property and without providing a refund of any payment the Guest has paid for the booking and the Owner will not be legally responsible to find any alternative accommodation.
7. Parking is limited to designated parking areas on the property only.
8. Pets are not allowed.
9. The Guest must not hold events (such as parties, celebrations, or meetings) at the property without the Owner's advance written consent. No professional sound system or DJ equipment is allowed on the property. Any of these cases will enable the Owner to terminate the Agreement without providing a refund of any payment the Guest has paid for the booking. The Owner will not be legally responsible for finding any alternative accommodation.
10. The Guest must allow the Owner or their representative (including workmen), with reasonable notice, access to the property at any reasonable time during your stay (except in an emergency or if a problem needs sorting out quickly and you cannot be contacted in time. In these situations, the owner can enter the property at any time without giving you prior notice).
11. The Guest is obliged not to make any changes in the rented property without prior receipt of agreement from the Owner in writing.
12. The Guest is responsible for keeping his valuables safe at all times. By agreeing to these Terms & Conditions, as acknowledged by booking on our website, the Guest waives, discharges, and agrees to hold harmless the Owner from all damages or injuries arising from or related to the Guest's stay at the property, including without limitation, any accidents, injury or death to the Guest, Guest's visitors and associates, theft and loss of money, jewellery or valuables of any kind. We strongly recommend that the Guest take travel insurance.
13. We regret we cannot accept liability or pay any compensation where our contractual obligations' performance or prompt performance is prevented or affected by 'force majeure'. In these Terms and Conditions, 'force majeure' means any event in which the supplier of the service(s) in question or we could not foresee or avoid, even with due care. Such events may include but are not limited to war, the threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside our control.
14. The Guest must deposit an amount of €2,000 - €3,500 (two thousand – three thousand five hundred EURO) depending on the property breakage deposit policy and extra services with the Owner on arrival by credit card. The Owner will block this breakage/extra services deposit. The deposit or balance thereof will be refunded (4) four days to the Guest when this Agreement expires and after the premises' inspection. The Owner may also utilise the deposit for government fines, the payment of amounts due and owing by the Guest in terms of this Property Short Term Rental Agreement and the cost of repairing damage (other than ordinary wear and tear) to the Premises, replacing lost keys or extra services. This provision is purely for the benefit of the Owner. It does not relieve the Guest from the obligation of any other payment or liabilities in terms thereof.
15. Law and Jurisdiction, the rental Agreement is ultimately between the Owner and the Guest. Any disputes arising from the rental of the property will be resolved between the Guest and the Owner. The Jurisdiction of this rental Agreement is Ibiza, Illes Balears, Spain.
16. Full refund for cancellations made within 24 hours of booking. If the check-in date is more than 60 days away, a 50% refund will be refunded. No refund if cancellations are made less than 60 days before the check-in date. We will accept cancellation or rescheduling booking due to COVID-19 if we are notified a minimum of 7 days before the check-in date. This COVID-19 cancellation policy is subject to the Guest's Government or the Spanish Government imposing an official lockdown/quarantine, and the Guest isn't allowed to travel on the booked dates. In such a case, we will offer our Guests a full refund or the option to reschedule their dates free of charge at the value of their original booking.
17. The person booking this property warrants he/she is older than 18 years and have the authority to use the credit card to make payment. The Guest has read the Terms & Conditions, understand them, and voluntarily agrees.
Additional Policies such as Rates and Fees, Check-In/Out Time, Cancellations, Minimum Stay, Smoking, Pets, Maximum Guests allowed, Children and age, Security Deposit Etc. will be according to the House rules or the Reservation policies, which are provided separately by the Owner.
General
● Any change or addition to this Agreement, House rules, and Reservation Policy will be valid only if carried out in writing and all sides have signed.
● Any announcement sent to either side from the other by email will be considered received after 72 hours of sending it.
● This Agreement (including any House rules or Reservation policy) expresses and reflects all agreed between the parties and cancels any agreements or other understandings between them.
